These Terms and Conditions govern access to and use of the website venusfirenze.com, purchases made through the site, and the contractual relationship between the customer and the seller regarding the products offered online.

Before making a purchase, please read these Terms and Conditions carefully, together with our Privacy Policy, Cookie Policy, Shipping Policy, and Return & Refund Policy, which form an integral part of the purchasing information.

The rights granted to consumers under applicable law, including the Italian Consumer Code (Legislative Decree 206/2005), remain unaffected in any case and cannot be limited by these Terms and Conditions.

Hereinafter, the entity indicated above will also be referred to as "Venus Leather Factory", "Venus Firenze", "Venus", "we", "us", or "our".

2. Scope of Application

These Terms and Conditions apply to the use of the site and to all purchases made through the Venus Firenze online store.

"Customer" means any natural or legal person who uses the site or purchases products offered through it.

When the customer purchases for purposes unrelated to any trade, business, craft, or professional activity, they are deemed a "consumer" under the Consumer Code.

Mandatory legal provisions protecting consumers shall prevail over any terms herein that may conflict with such provisions.

3. Website Usage

Use of the website is permitted exclusively for lawful purposes and in compliance with these Terms and Conditions and applicable regulations.

The customer agrees not to use the site:

  • For unlawful or fraudulent purposes;

  • To violate intellectual property rights or other rights of Venus Firenze or third parties;

  • To transmit viruses, malware, or other harmful code;

  • To interfere with the proper functioning of the site or related systems;

  • To collect, extract, or use data on the site using unauthorized automated systems (data scraping);

  • To attempt unauthorized access to systems, accounts, or data;

  • To provide false, incomplete, or misleading information;

  • To place fraudulent orders or use unauthorized payment methods.

Venus Firenze reserves the right to take any necessary action to protect the site, its systems, and its customers in the event of illegal or abusive use.

4. Product Information & Craftsmanship

Venus Firenze strives to provide descriptions, images, and product details that are as accurate and up to date as possible.

Product images are provided for illustrative purposes. Color accuracy, shades, and fine details may vary depending on the customer's display device, screen settings, and lighting conditions.

As our products are crafted from leather, hide, or other fine natural materials, any slight variations in grain, tone, veining, minor surface irregularities, or inherent material characteristics attest to the authenticity and artisanal quality of the product and do not constitute a lack of conformity.

Venus Firenze may modify product descriptions, features, availability, and images at any time for commercial or technical reasons. Such changes will not affect orders already validly concluded and confirmed.

5. Product Availability

Product availability indicated on the website is verified in real time.

In the event of unexpected unavailability of a product after an order has been placed, Venus Firenze will promptly notify the customer via email. If the product cannot be supplied or if the estimated waiting time is unacceptable to the customer, Venus Firenze will issue a full refund for the affected item.

6. Pricing & Customs Fees

Product prices are those displayed on the site at the time the order is submitted. Unless otherwise indicated, prices for EU-based consumers are expressed in Euros (€) and include applicable VAT.

Shipping fees are not included in the product price and are clearly displayed before order completion during checkout.

Non-EU Shipments: For shipments outside the European Union (e.g., United Kingdom, Switzerland, USA, Canada, etc.), customs duties, import taxes, local VAT, and clearance charges may apply. These charges are not included in the purchase price or shipping fees and are the sole responsibility of the recipient, as detailed in our Shipping Policy.

7. Orders & Contract Conclusion

Before completing a purchase, the customer is shown an order summary containing selected items, price details, taxes, and applicable shipping costs.

Submitting an order via the checkout process and clicking the final confirmation button constitutes a binding contractual offer from the customer.

The sales contract is concluded when Venus Firenze sends an order confirmation email to the address provided during checkout.

8. Rejection or Cancellation of Orders

8.1 Order cancellation requested by the customer:

The customer may request order cancellation by sending a written communication to info@venusfirenze.com within a maximum timeframe of 12 hours from the time of purchase, and strictly before the order has been processed, fulfilled, taken in charge for preparation, or handed over to the courier.

If the order has already been processed (for personalized products) or handed over to the carrier, it can no longer be canceled. However, the customer may still exercise the right of withdrawal upon receipt of the goods, where applicable pursuant to Section 12 of these Terms.

Exclusions from cancellation:

Gift Cards and digital products are automatically generated and issued upon order confirmation; therefore, they cannot under any circumstances be canceled or refunded, even if an option for scheduled or delayed delivery to the recipient was selected.

8.2 Order cancellation or refusal by Venus Firenze:

Venus Firenze reserves the right not to accept or to cancel an order in the following cases:

  • Physical unavailability of the goods in stock;

  • Obvious and recognizable errors in the price or description of the product on the website;

  • Suspicion of fraudulent or unlawful transactions, or orders placed using unauthorized payment methods;

  • Failed authorization or non-completion of payment;

  • Incomplete, incorrect, or invalid shipping details.

In the event of a timely cancellation or non-acceptance of an order that has already been charged, Venus Firenze will promptly refund the entire amount paid by the customer using the same payment method used for the purchase.

9. Payment Methods

Accepted payment methods are exclusively those displayed during checkout on the site (e.g., Credit Cards, PayPal, Klarna, etc.).

Payments are processed securely via respective third-party payment gateways. Venus Firenze does not directly store or handle credit card numbers or financial data.

10. Invoicing

If a commercial invoice is required, the customer must request it at the time of placing the order, providing all required tax details (Tax Code/SSN, VAT ID, Tax Identifier). Invoices cannot be issued once the order has been dispatched.

11. Shipping & Delivery

Processing methods, estimated delivery timelines, applicable shipping rates, and logistics terms are governed in detail by our Shipping Policy, which forms an integral part of these Terms.

In accordance with Consumer Code provisions, Venus Firenze commits to delivering goods without undue delay and no later than 30 days from contract conclusion, unless otherwise agreed or in cases of force majeure.

The risk of loss or damage remains with Venus Firenze until the consumer (or a designated third party) acquires physical possession of the goods.

12. Right of Withdrawal

Under consumer regulations, the consumer has the right to withdraw from the purchase contract without penalty and without stating a reason, within 14 days from the day on which they acquire physical possession of the product.

To exercise this right, the consumer must send an explicit written notice to info@venusfirenze.com before the 14-day deadline expires.

Direct costs for returning the item to the Venus Firenze warehouse are borne entirely by the customer. Operational instructions, packaging requirements, and return procedures are specified in our Return & Refund Policy.

13. Refunds & Return Conditions

Following a notice of withdrawal and receipt of the returned item at our warehouse, Venus Firenze will inspect the condition of the goods.

  • If the withdrawal covers the entire order, the refund will include the item cost plus standard initial shipping charges. Any additional costs chosen by the customer for express or special shipping services are non-refundable.

  • Venus Firenze reserves the right to withhold the refund until the goods have been physically received and successfully inspected.

The consumer is liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the product (e.g., tag removal, damage, dirt, or missing original packaging).

Non-EU Returns: Any customs duties, clearance fees, import VAT, or storage costs incurred by Venus Firenze for processing returns originating from outside the European Union will be fully deducted from the final refund.

14. EXCLUSION OF THE RIGHT OF WITHDRAWAL: PERSONALIZED PRODUCTS AND GIFT CARDS

Pursuant to Article 59, Paragraph 1, Letters c) and o) of the Italian Consumer Code, the right of withdrawal is completely excluded for:

  • Custom-made or clearly personalized products (e.g., items featuring engravings, embroideries, monograms, or custom processing requested by the customer);

  • Gift Cards and digital products once issued and delivered to the customer.

Such products and services cannot be subject to cancellation, return, refund, or exchange, except in cases of lack of conformity or manufacturing defects of a physical product.

15. Product Exchanges & Store Credit

Direct item exchanges (e.g., size or color swap) represent an optional commercial service offered by Venus Firenze and not a statutory legal obligation.

If a customer prefers to receive Store Credit / Voucher instead of a monetary refund, this choice is completely voluntary and governed by the terms specified in our Return & Refund Policy.

16. Intellectual Property

All content on the venusfirenze.com website—including but not limited to trademarks, logos, text, graphics, photographs, illustrations, videos, layout, and software—is the exclusive property of Venus Firenze or used under authorized license from respective rights holders.

Any reproduction, modification, distribution, publication, or commercial exploitation of such content without prior express written consent from Venus Firenze is strictly prohibited.

17. Limitation of Liability

Venus Firenze takes all reasonable measures to ensure the site is free from viruses, errors, or service interruptions. However, uninterrupted access or freedom from technical glitches cannot be guaranteed.

Venus Firenze is not liable for damages arising from force majeure events or unforeseen circumstances beyond its reasonable control (e.g., strikes, natural disasters, customs holds, internet service or transport disruptions).

18. Shopify Platform

The Venus Firenze online store is hosted on the Shopify e-commerce platform, which provides the technological infrastructure. The contract of sale is exclusively concluded between the customer and Venus Firenze. Shopify is not a party to the sales contract and assumes no liability toward the buyer.

19. Privacy & Cookies

Personal data is processed in accordance with EU Regulation 2016/679 (GDPR) and national privacy legislation. For full details, please consult our Privacy Policy and Cookie Policy.

20. Applicable Law & Jurisdiction

These Terms and Conditions and all contracts concluded via the website are governed by and construed in accordance with Italian law, without prejudice to mandatory consumer protection laws in the buyer's country of residence.

For any disputes arising from the interpretation, execution, or validity of these Terms involving consumers, mandatory jurisdiction rests with the Court of the place of residence or domicile of the consumer, provided it is located within Italy or the European Union.

Pursuant to Article 14 of EU Regulation No. 524/2013, consumers are informed that the European Commission provides an Online Dispute Resolution (ODR) platform, accessible at: https://ec.europa.eu/consumers/odr/.
